A licensing investigation can begin long before formal disciplinary charges are filed. Understanding what the Department is investigating, what information is being requested, and how the process works is critical to making informed decisions at the earliest stage.
When a licensing investigation begins
Florida healthcare licensing matters may arise from patient complaints, employer reports, criminal matters, application disclosures, malpractice-related information, inspections, other agencies, or information otherwise received by the Department of Health. The precise procedure can vary with the profession and allegation.
An investigation is not yet a finding of wrongdoing
The investigative stage is used to gather information and determine whether a matter should proceed. A complaint or investigation does not itself establish that a statutory or regulatory violation occurred.
But the response can matter later
Written explanations, records, interviews, and other information developed during an investigation may become important if the case proceeds to probable cause review or formal discipline.

From investigation to probable cause
After the investigative record is developed, a matter may be closed or may move forward for review under the procedures governing the particular board and profession. If probable cause is found, formal disciplinary proceedings may follow through an Administrative Complaint.
