Emergency Suspension and Restriction of Florida Healthcare Licenses

Florida law permits emergency action against healthcare licenses in circumstances defined by statute and administrative law. An emergency suspension or restriction is fundamentally different from the ordinary sequence in which investigation precedes formal charges and a later final disciplinary decision.

Emergency action can affect practice immediately

The defining feature of an emergency order is that it can restrict a professional’s ability to practice before the ordinary disciplinary case is finally resolved. Chapter 456 includes provisions addressing immediate suspension in specified circumstances, and other emergency authority may also apply.

The emergency order and underlying case are related but distinct

The professional may need to address both the immediate effect of the emergency order and the underlying allegations that can proceed through the disciplinary process. Different procedural avenues and deadlines may apply.

Read the actual order

The factual findings, legal authority, restrictions imposed and notice of review rights in the particular order are critical. Emergency cases should not be evaluated from the title of the order alone.
