Florida Administrative Complaints Against Healthcare Professionals: What Happens Next?

An Administrative Complaint marks a major procedural change in a Florida healthcare licensing case. The matter has moved beyond investigation into formal allegations that may result in discipline against the professional license.

Read the charges and accompanying notice together

The complaint identifies the alleged conduct and legal violations. The accompanying notice or Election of Rights addresses how the respondent may contest the proposed agency action. The procedural route can turn on whether material facts are disputed.

Disputed material facts matter

Florida’s Administrative Procedure Act distinguishes proceedings involving disputed issues of material fact from those that do not. Section 120.57(1) provides the formal-hearing procedures applicable when material facts are disputed, including presentation of evidence, cross-examination and a recommended order process.

Deadlines should not be ignored

The papers served with the complaint specify the available rights and deadline for exercising them. Florida Department of Health enforcement materials state that a respondent served with an Administrative Complaint generally has 21 days to return the Election of Rights.
