What Is a Probable Cause Panel in a Florida Healthcare Licensing Case?

Probable cause review is the point at which a Florida healthcare licensing investigation may transition into formal disciplinary charges. It is not the final hearing on whether a violation occurred.

The panel’s role

Under section 456.073, Florida Statutes, probable cause is determined through the statutory process applicable to the board or profession. The question is whether the investigative material supports moving forward with disciplinary action.

Probable cause is not final discipline

If probable cause is found, an Administrative Complaint may follow. The professional still has procedural rights to contest the allegations. If probable cause is not found, the matter may be closed, subject to the governing statutory process.

Why earlier evidence matters

The probable-cause decision is based on the record developed before formal charges. That is one reason responses, records and other evidence submitted during the investigative stage can be significant.
