Florida Nurse License Investigations: Common Issues and What the Process Looks Like

Florida nurses may encounter Department of Health investigations arising from patient complaints, employer reports, medication or documentation allegations, criminal matters, impairment concerns, application issues, or information received from another jurisdiction.

The allegation defines the evidence

A patient-care case may turn on medical records, policies and clinical testimony. A medication case may involve administration records and pharmacy data. An application or criminal matter may depend on court records, disclosures and the wording of prior submissions. There is no single investigative record for every nursing case.

Chapter 464 and Chapter 456 work together

The Nurse Practice Act contains profession-specific grounds for discipline, while Chapter 456 supplies general provisions that apply across Department-regulated health professions. Both may need to be considered when evaluating an allegation.

Investigation can lead to probable cause review

After the investigative record is developed and reviewed, the case may be closed or move toward probable cause and formal disciplinary proceedings.
